These Terms of Service ("Agreement", "Terms") constitute a legally binding agreement between KREONE EMPIRE PRIVATE LIMITED ("Company", "we", "us", or "our"), operating under the commercial hosting brand Kreone Host ("Service"), and the individual or legal entity ("Customer", "Client", "You") who accesses or uses our web hosting services, servers, client portal, or related products.

By ordering, activating, or using any services from Kreone Host, you acknowledge that you have read, understood, and agreed to be bound by these Terms.

Kreone Host provides shared web hosting, cloud solutions, and server infrastructure governed under Indian corporate and cyber laws.

2. Acceptable Use Policy (AUP) & Prohibited Content

You agree to use our services solely for lawful purposes. The transmission, storage, or distribution of any material that violates applicable Indian laws or regulations is strictly prohibited.

Prohibited activities and content include, but are not limited to:

• Unsolicited Communications: Bulk emailing, spamming, unauthenticated mailing lists, email spoofing, or hosting spam-advertised links.

• Malicious Software & Security Threats: Malware, ransomware, spyware, trojans, viruses, rootkits, phishing kits, port scanners, denial-of-service (DoS/DDoS) tools, or vulnerability exploit scripts.

• Unauthorized Access & Hacking: Hosting exploit databases, hacking forums, brute-force tools, botnets, command-and-control (C&C) infrastructure, or network sniffing utilities.

• Adult & Explicit Content: Commercial pornography, sexually explicit material, escort services, or related media.

• Copyright & IP Infringement: Pirated software (warez/nulled scripts), torrent trackers/clients, illegal music/movie streaming, or distribution of copyrighted material without express licensing.

• Cryptocurrency Mining: Unauthorized CPU/GPU-intensive cryptocurrency mining or background blockchain computational scripts.

• Unverified/Fake News Platforms: Platforms running fabricated, malicious, deceptive, or hate-inciting news networks that violate Indian media and IT regulations.

3. Server Resource Utilization & Fair Usage

To ensure stability, performance, and uptime across shared hosting environments:

• Resource Spikes: Accounts must not consistently monopolize server CPU, RAM, I/O speed, or database connection limits.

• Cron Jobs: Automated cron jobs must not be scheduled to execute more frequently than once every 15 minutes. High-frequency or minute-by-minute crons are prohibited on shared hosting.

• File Storage Policy: Shared hosting plans are intended for hosting live website files and databases only. Using accounts as mass file-storage repositories, cloud storage drives, video archiving hubs, or external personal backup storage is prohibited.

Resource Violation & Suspension Procedure:

1. First Warning: If an account exceeds resource limits or impairs server stability, a notice will be issued via support ticket/email, with a temporary freeze if necessary to safeguard server operations.

2. Second Warning: If excessive utilization persists, a second notice with a maximum resolution window of 5 calendar days will be provided.

3. Termination: Failure to resolve the resource issue after final notice will result in account suspension and eventual termination.

4. Billing, Invoicing, Suspension & Termination

• Billing Cycles: Invoices are generated automatically in advance of each recurring billing cycle. Invoices are payable on or before the due date indicated on the billing receipt.

• Payment Gateways: Payments must be completed via official integrated payment gateways (Razorpay, Cashfree, PhonePe) or authorized corporate bank transfers.

• Overdue Suspension (3 to 5 Days): If an invoice remains unpaid 3 to 5 calendar days past its due date, the hosting account will be automatically suspended.

• Data Deletion / Termination (8 to 10 Days): If an invoice remains unpaid for 8 to 10 calendar days following the due date, the account will be permanently terminated, and all associated data, databases, and emails will be purged from the server without liability.

5. Data Backups & Customer Responsibility

• Customer Responsibility: Customers are 100% responsible for maintaining independent, off-site, and up-to-date backups of all their website files, databases, configurations, and email accounts.

• Automated Systems: While Kreone Host deploys automated routine system snapshots and attempts reasonable backup measures for server maintenance, backups are provided on an "As-Is" and "As-Available" basis.

• No Data Loss Liability: Under no circumstances shall KREONE EMPIRE PRIVATE LIMITED or Kreone Host be held liable for any data corruption, accidental deletion, system failure, or loss of information.

6. Service Uptime & Maintenance

• We strive to maintain 99.9% server availability.

• Scheduled maintenance, emergency hardware replacements, software upgrades, upstream network provider failures, or DDoS attacks beyond our control do not qualify as unscheduled downtime or breach of contract.

7. Limitation of Liability & Indemnification

• Limitation of Liability: To the maximum extent permitted by Indian law, KREONE EMPIRE PRIVATE LIMITED shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or business disruption resulting from the use or inability to use our services.

• Indemnification: You agree to indemnify, defend, and hold harmless KREONE EMPIRE PRIVATE LIMITED, its directors, officers, employees, and agents from any claims, damages, liabilities, and expenses (including legal fees) arising from your website content, misuse of services, or breach of this Agreement.

8. Governing Law & Dispute Resolution

• Applicable Law: This Agreement shall be governed by, interpreted, and construed in accordance with the laws of the Republic of India and the Information Technology Act, 2000.

• Jurisdiction: Any dispute, claim, litigation, or legal proceeding arising out of or related to these Terms or services rendered by Kreone Host shall be subject to the exclusive jurisdiction of the competent courts located in Shahjahanpur, Uttar Pradesh, India.

9. Modifications to Terms

KREONE EMPIRE PRIVATE LIMITED reserves the right to revise, update, or modify these Terms of Service at any time. Changes will be published on the official website with an updated revision date. Continued usage of Kreone Host services following any changes constitutes full acceptance of the revised Terms.
